TERMS AND CONDITIONS – ATTY CRONIN LTD.

1. DEFINITIONS

1.1 When the following words with capital letters are used in these Terms, this is what they will mean:

- Event Outside Of Our Control: is defined in clause 7

- Order: your order for the Services as set out in your program agreement

- Services: the coaching services that we are providing to you as set out in the Order

- Sessions: the coaching sessions, which may be online or in-person

- Terms: the terms and conditions set out in this document

- I/Me/My/We/Our/Us: Atty Cronin Ltd (The Company), trading as Atty Cronin

- The Company: Atty Cronin Ltd

- Client: You

1.2 When we use the words "writing" or "written" in these Terms, this will include email or any written messages on agreed communication platforms unless we say otherwise.

2. OUR CONTRACT WITH YOU

2.1 You are engaging the company for Coaching and Mentoring services with Atty Cronin, and We will provide Our Services to you on these Terms.

2.2 These Terms will become binding when We contact you by email to confirm acceptance of your Order and that We are happy to provide the Services to you, at which point a payment will be made by you and a contract will be formed between you and Us.

3. SESSION AND COMMUNICATION POLICIES

3.1 Sessions require 48 hours notice for cancellation or rescheduling.

3.2 If you are more than 10 minutes late to a session, it will be considered forfeited. Any rebooking will be at Atty Cronin's sole discretion.

3.3 Communication response times are within 48 hours during working days only. Working days are Monday through Friday, 9:00 AM to 6:00 PM UK time, excluding UK public holidays.

3.4 Specific communication channels and support levels between sessions will be detailed in your individual program agreement.

3.5 All session times and working hours are based on UK time (GMT/BST). Clients are responsible for managing any time zone differences when scheduling sessions.

4. CONFIDENTIALITY AND RECORDING

4.1 Sessions may be recorded via Zoom and Fathom for quality assurance and professional development purposes.

4.2 Session recordings, transcripts, and notes are stored securely on a private Google Drive.

4.3 Session materials may be reviewed for professional accreditation purposes.

4.4 Clients may request access to their own session recordings and transcripts.

4.5 Client information will not be shared with third parties except as required for professional accreditation purposes.

5. PAYMENT AND FEES

5.1 Program fees will be detailed in your individual program agreement.

5.2 Payment options include:

- Full payment upfront

- Instalment plans as agreed in your program agreement

5.3 Accepted payment methods are:

- Credit/debit card

- Apple Pay

- Link

5.4 All payments are non-refundable.

5.5 For instalment plans, all payments must be made on the agreed dates. Failure to make payments may result in termination of services.

6. PROGRAM MATERIALS AND INTELLECTUAL PROPERTY

6.1 All materials, methodologies, and content provided during the coaching relationship remain the intellectual property of Atty Cronin Ltd.

6.2 Clients may access their personal session recordings and transcripts but may not share, distribute, or repurpose these materials without written consent.

6.3 Any resources provided during the program are for personal use only and may not be copied, distributed, or used for commercial purposes

7. BOOKING AND SCHEDULING

7.1 All session bookings and rescheduling must be done through the calendar booking links provided.

7.2 Access to booking links will be provided upon programme commencement.

7.3 Rescheduling must comply with the 48-hour notice requirement as specified in clause 3.1.

8. PROGRAMME COMPLETION

8.1 Programmes must be completed within the timeframe specified in your individual programme agreement.

8.2 For 90-day programmes, all sessions must be completed within 4 months of the start date, unless otherwise agreed in writing.

8.3 Any extension to programme completion timeframes is at the sole discretion of Atty Cronin Ltd.

8.4 Unused sessions may be forfeited if not completed within the agreed timeframe.

9. EVENTS OUTSIDE OUR CONTROL

9.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under these Terms that is caused by events outside Our reasonable control ("Force Majeure Event").

9.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Our reasonable control including but not limited to:

- Internet or telecommunications failures

- Illness

- Technical failures

- Power cuts

- Civil unrest, war, or natural disaster

9.3 Our obligations under these Terms will be suspended for the duration of the Force Majeure Event.

9.4 If a Force Majeure Event continues for longer than 4 weeks, either party may terminate this agreement by giving written notice.

10. LIABILITY

10.1 We shall provide the Services with reasonable care and skill.

10.2 Our total liability under these Terms shall be limited to the total amount paid by you for the Services.

10.3 Nothing in these Terms shall limit or exclude Our liability for:

- Death or personal injury caused by Our negligence

- Fraud or fraudulent misrepresentation

- Any matter for which it would be illegal for Us to exclude or limit Our liability

While I'm committed to supporting your journey and providing you with tools and strategies, I cannot and do not guarantee specific results from our coaching relationship. The outcomes of coaching depend on various factors, including but not limited to your commitment, engagement, actions taken, and circumstances beyond either of our control. Any examples of client results shared are for illustration only and do not guarantee or promise that you will achieve the same or similar results. Your success depends entirely on your dedication, circumstances, and implementation of any strategies discussed during our sessions. By engaging in coaching services with Atty Cronin Ltd, you acknowledge and accept that results will vary for each individual and no specific outcome is promised or guaranteed.
